Terms of Service

By accessing and using the Avery Aesthetics online store (the “Store”), you agree to be bound by the following Terms of Service. Please read them carefully before making a purchase.
1. About Our Store
Avery Aesthetics operates an online store selling medical-grade skincare and cosmetic products. Our store is structured into three distinct purchasing tiers:
• Consultation-Required Products — Accessible by password only, to clients who have completed a prior consultation with an Avery Aesthetics clinician.
• In-Clinic Purchase Only — Products that can be browsed online but must be purchased in person at our clinic, under clinician guidance.
• Open Store Products — Products available for purchase by any visitor to our online store without restriction (e.g. Avocado Zinc and selected skincare).
2. Password-Protected Products
Certain medical-grade products are restricted to clients who have undergone a consultation with an Avery Aesthetics clinician. By entering a product password, you confirm that:
• You have completed a consultation with an Avery Aesthetics clinician
• The product has been recommended or approved for your personal use
• You will not share the password with any third party
• You accept full responsibility for all purchases made using your password
Important: Misuse of consultation-required passwords, including sharing them with individuals who have not had a consultation, may result in account suspension and could pose serious skin health risks. Avery Aesthetics accepts no liability for adverse reactions arising from unsupervised use of restricted products.
3. Eligibility to Purchase
You must be at least 18 years of age to make a purchase from our Store. By completing a purchase, you confirm that you meet this requirement. We reserve the right to request age verification at any stage and to cancel any order where we have reason to believe this condition has not been met. A refund will be issued for any order cancelled on this basis.
4. Product Information & Medical Disclaimer
Product descriptions and information on our Store are provided for informational purposes only and do not constitute medical advice. Results may vary between individuals. We strongly recommend that all customers consult with a qualified clinician before introducing new products — particularly medical-grade formulations — into their skincare routine.
Avery Aesthetics is not liable for any adverse reactions resulting from the use of products purchased against the advice of a clinician, or for use of consultation-required products by individuals who have not undergone an appropriate consultation.
5. Pricing & Payment
All prices are listed in Australian Dollars (AUD) and are inclusive of GST where applicable. We reserve the right to amend pricing at any time without notice. Payment is processed securely through Shopify’s payment gateway. We accept major credit cards and other payment methods as listed at checkout.
6. Order Acceptance & Cancellation
Placement of an order does not constitute a binding contract until you receive an order confirmation email from us. We reserve the right to cancel or refuse any order at our discretion, including but not limited to cases of suspected password misuse, stock unavailability, or errors in pricing.
Where Avery Aesthetics cancels an order, you will be notified by email and a full refund will be processed to your original payment method within 5–10 business days.
Returns and refunds for customer-initiated cancellations are governed by our Return & Refund Policy.
7. Dispute Resolution
If you have a complaint or dispute arising from your use of the Store or a purchase, we encourage you to contact us first at concierge@averyplasticsurgery.com.au so that we can attempt to resolve the matter informally. We aim to respond to all complaints within 2 business days.
If a resolution cannot be reached through direct communication, either party may escalate the matter in accordance with the governing law set out in Clause 10.
8. Intellectual Property
All content on the Avery Aesthetics Store — including images, text, logos, and product descriptions — is the intellectual property of Avery Aesthetics Pty Ltd and may not be reproduced, distributed, or used without prior written consent.
9. Privacy & Cookies
We handle your personal information in accordance with our Privacy Policy and the Australian Privacy Act 1988. Your information is used solely for the purpose of processing orders, communicating with you about your purchases, and improving our services. We do not sell or share your data with third parties except as required to fulfil your order.
Our Store may use cookies and similar tracking technologies for analytics and functionality purposes. By continuing to use the Store, you consent to their use. For more information, please refer to our Cookie Policy.
10. Limitation of Liability
To the maximum extent permitted by Australian Consumer Law, Avery Aesthetics will not be liable for any indirect, incidental, or consequential loss or damage arising from the use of our products or Store. Where liability cannot be excluded, it is limited to the value of the relevant order.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee or right you have under the Australian Consumer Law.
11. Force Majeure
Avery Aesthetics will not be liable for any delay or failure to perform our obligations where such delay or failure results from circumstances beyond our reasonable control, including but not limited to natural disasters, supply chain disruptions, carrier failures, pandemics, or government-imposed restrictions. We will notify affected customers as soon as practicable and endeavour to fulfil orders as quickly as circumstances allow.
12. Governing Law
These Terms are governed by the laws of New South Wales, Australia. Any disputes that cannot be resolved informally will be subject to the exclusive jurisdiction of the courts of New South Wales.
13. Changes to These Terms
We may update these Terms from time to time. The current version will always be published on this page with the effective date. Continued use of the Store after changes are posted constitutes your acceptance of the updated Terms.
